{"id":3966,"date":"2015-02-20T00:56:18","date_gmt":"2015-02-20T02:56:18","guid":{"rendered":"https:\/\/www.pnst.com.br\/?p=3966"},"modified":"2023-03-01T21:04:17","modified_gmt":"2023-03-02T00:04:17","slug":"judiciary-branch-removes-additional-10-penalty-over-fgts-paid-in-dismissals-without-cause","status":"publish","type":"post","link":"https:\/\/www.pnst.com.br\/en\/articles\/labor-consulting-and-litigation\/judiciary-branch-removes-additional-10-penalty-over-fgts-paid-in-dismissals-without-cause\/","title":{"rendered":"Judiciary Branch Removes Additional 10% Penalty over FGTS Paid in Dismissals Without Cause"},"content":{"rendered":"<p>Judiciary Branch has been issuing favorable injunctions to the taxpayers, excluding the additional penalty of 10% (General Social Contribution) over Employee Severance Indemnity Fund &#8211; FGTS paid in case of dismissals without cause.<\/p>\n<p>Currently, to dismiss without cause, besides FGTS\u2019 penalty of 40% destined to the employee, the companies must pay this additional penalty of 10%, which is passed on to the Government.<\/p>\n<p>The General Social Contribution was stated to adjust distortions that were resulted from Brazilian economic plans known in Portuguese as \u201cPlano Ver\u00e3o\u201d and \u201cPlano Collor\u201d (monetary adjustment of FGTS\u2019s accounts due to understated inflation). However, those distortions no longer exists since 2007 and &#8211; considering the absence of the purpose to which this additional penalty was created &#8211; the amounts collected had their destination totally distorted.<\/p>\n<p>There are two Direct Unconstitutionality Actions &#8211; ADINs in progress before Brazilian Federal Superior Court &#8211; STF to issue a final decision about this matter.<\/p>\n<p>In the meantime, the taxpayers can file a suit to avoid the payment of the 10% penalty, as well as to recognize the right of tax refund or even of tax offsetting regarding the amounts collected in the past 5 years, counting from the lawsuit filing.<\/p>\n<br>\r\n<em><strong>Tax Team<\/strong> at Pacheco Neto Sanden Teisseire Law Firm.\r\n<\/em>\n","protected":false},"excerpt":{"rendered":"<p>Judiciary Branch has been issuing favorable injunctions to the taxpayers, excluding the additional penalty of 10% (General Social Contribution) over Employee Severance Indemnity Fund &#8211; FGTS paid in case of dismissals without cause.
